ConsensusDocs Webinar–ConsensusDocs P3 Keys to Contracting Success

This free NASBP-supported ConsensusDocs webinar, “ConsensusDocs P3 Keys to Contracting Success,” helps surety professionals and their contractor clients assess the risks in pursing potential public-private-partnership (P3) projects and key points to negotiate. Often P3 contracts can be hampered by complicated agreements that unfairly shift risk to parties that cannot control or manage such risks. Presenter Brian Perlberg, ConsensusDocs Executive Director and Senior Counsel, and Ernest C. Brown, Esq. describe how the new ConsensusDocs 900–a standard owner/concessionaire agreement to design, build, finance, operate, and maintain (DBFOM)–provides a short, comprehensive, and fair contract for P3 projects. The presenters explain how to structure a P3 agreement to DBFOM a project, different approaches to take contractually for a financial mechanism, and P3 contractual best practices. Listen to find out how the ConsensusDocs 900 can significantly lower the transactional costs for creating and negotiating a P3 project.

The webinar can be viewed at https://www.youtube.com/watch?v=gPgJSUd_mIU&t=4s  Also, download three free sample contracts by going to www.consensusdocs.org and registering for a free account.

NASBP Virtual Seminar–Using Master Subcontracts: Become More Efficient In Negotiating Subcontracts

Last month NASBP invited Perlberg to present the NASBP Virtual Seminar, “Using Master Subcontracts: Become More Efficient In Negotiating Subcontracts.” Perlberg described how many prime contractors and subcontractors have become more efficient in creating a master standard agreement with general terms and conditions and then issue individual work orders for each project or subcontract work scope. He explained how the new ConsensusDocs Standard Master Subcontract Agreement and Project Work Order (ConsensusDocs 755 and 756, respectively) create best practice templates for master subcontracting that prime contractors and subcontractors can use immediately off-the-shelf. He explained how the document helps contractors and subcontractors avoid wasting time repeatedly negotiating complex legal terms with the same parties.

Perlberg addressed why general contractors and subcontractors should use master subcontracts and purchase work orders; when to use the NEW ConsensusDocs Master Subcontract Agreement; how to organize a master subcontract’s terms and conditions and a project work order with project specifics; how the New ConsensusDocs 755 Master Subcontract and 756 Project Work Order provide an off-the-shelf solution to create a master subcontract and work order; and provided an overview of ConsensusDocs best practice subcontracting terms addressing indemnification, project financial information, release of retainage, lien release, and additional insured.
